Suresh Kumar vs. Amrit Kumar [AIR 1982 Del 131]

Different between retirement of partner and dissolution of partnership

15. It is well settled that retirement is not the same thing as dissolution. On retirement of a partner the firm continues to exist as such which is not the case when a partnership is dissolved. Technically speaking retirement is a severance of the interest of a partner from the partnership business and is not tantamount to determination of the partnership as a whole, the other partners continue to carry on the business of the firm. On the contrary, the dissolution of a partnership completely destroys jural relationship as partners between all the partners and the question of partnership business being carried on by partners other than the outgoing partner does not arise.
