Contractual disputes - Litigating Hand

The world today is a world of commerce involving contractual arrangements nearly at every step. These arrangements are the bedrock for the recognition, performance, and enforcement of various rights or obligations arising therefrom. Contracts generate expectations which when breached by any party, lead to disputes and litigations before different courts and tribunals including arbitral tribunals. Parties often seek remedies like specific performance of these contracts, damages, compensation, injunctions, declarations, and multiple other rights and remedies depending on the subject matter of the contract. The Office has represented various clients in their litigations arising from such contractual engagements and help them avail best remedies before various judicial forums.

Corporate Disputes - Litigating Hand

The specific acts and affairs of the corporate entities are presently regulated by the Companies Act, 2013 and various rules framed thereunder. The need to consult in this branch of law often arises at the initial stage i.e., the performance of due diligence and for advisory purposes and subsequent stages i.e., where disputes arise and parties approach different tribunals and courts for various remedies. The office has principally represented several stakeholders in disputes relating to allotment of shares, appointment/removal of directors, liability of various office bearers including directors, revival of companies after having been struck off the Register of Companies, applications for investigations, operation and mismanagement of the minority shareholders, and other like proceedings under the Act and associated rules.

Since time immemorable, property has been one of the most important and expensive jewel of any particular person. Often stakeholders of the property engage or are compelled to engage in various transfer deeds like Agreement to sell, Sale Deeds, Mortgage Deeds, Lease Deeds, Gift Deeds of the both movable and immovable property. Similarly, the disputes also arise on inheritance and succession of property, enforcement and challenges to ‘wills’, partition of property, and likewise. Bankruptcy law

Over the last decade, litigations relating to insolvency and bankruptcy have sparked enormously. These disputes are presently governed by the Insolvency and Bankruptcy Code, 2016 which is a consolidated law for the preparation of resolution plans for corporate debtors and failing it, liquidation of the company. The Act provides for speedy and efficient remedies like keeping the entities a going concern where possible and liquidation of it where the companies fail in preparation of resolution plans and payment of debts. This Office has represented many Operational Creditors, Financial Creditors, and Corporate Debtors from various sectors before Ld. National Company Law Tribunals, the National Company Appellate Law Tribunal, and the Supreme Court of India.

Every person is a consumer of one or the other goods and services which vary from purchasing products at a general store, to a home, to a medical equipment or medical service.

Indian Penal Code - Litigating Hand

Offences under the Indian Penal Code

Protection of body and property of any person has been one of the earliest areas to be regulated by law and judicial adjudication. This area of law calls for dedicated experience and practice as often the direct effect of offences, particularly, offences relating to the body is on the life and liberty of the person/accused and his family. Litigating Hand has represented various accused persons in criminal appeals, bail proceedings, quashing petitions, and other miscellaneous proceedings.

Offences under the special legislation

In addition to various offences punishable under the Indian Penal Code ranging from threat to murder, the legislature has often felt the need for special legislation for particular offences relating to money laundering, NDPS, corruption, negotiable instruments, customs, , marriage, etc. This is generally motivated to strongly discourage and deter people from particular crimes having a significant socio-economic impact.

a.    PMLA Matters

This Act subjects an accused to two proceedings i.e., prosecution for money laundering and attachment proceedings of tainted properties. This includes representation before the Adjudicating Authority, Appellate Authority, High Court, & Supreme Court for remedies like appeal, bails, and de-attachment proceedings. Litigating Hand has represented various accused persons in proceedings under the PMLA, 2002 before said forums.

b.    NDPS Matters

Like PMLA, the proceedings under the Narcotic Drugs and Psychotropic Substances Act, 1985 can be classified into criminal prosecution and civil proceedings i.e., attachment/forfeiture of properties. Litigating Hand is experienced in representing accused persons in various stages of criminal proceedings like bail petitions, appeals against convictions and civil litigation seeking release of attached/forfeited property.

c.    Prevention of Corruption Act

The Act has established special courts and process for prosecuting public servants accused of engaging in corrupt practices while executing different official duties. This Office has represented various public servants accused in such cases and availing remedies in different matters.

d.    Negotiable Instruments

Cheque is one of the modes of transfer or payment by a person. However, as the transfer or payment made through cheque does not take place immediately often for various reasons the issued cheques bounce and payment is failed. Initially, such a dishonor of cheque was considered as civil and subsequently, in 1988 it was criminalized. The office has since long represented numerous complainants and accused in cheque dishonor cases.

Matrimonial Disputes covers a wide variety of disputes like dissolution of marriage, awarding of child custody, cases of domestic violence, cruelty, dowry death, and more. This Office understands the mental agony of the parties and has often either helped them reach an amicable settlement or seek the above-said reliefs and & reliefs against convictions & acquittals, quashing of FIRs in the original and appellate courts in Delhi.
